Terms of Service

These Terms of Service ("Terms") govern your use of the Dogear mobile application and related services (together, the "Service"). By using the Service you agree to these Terms. If you don't agree, please don't use the Service.
1. Who can use Dogear
You must be at least 13 years old (or 16 in regions where that is the minimum age for online consent) to use the Service. You agree to provide accurate information when you sign up and to keep your account credentials secure. You are responsible for everything that happens on your account.
2. Your content
"Your content" means the highlights, notes, comments, profile information, and any other material you post or upload to the Service.
- You retain ownership of Your content.
- You grant us a license to host, store, transmit, display, and back up Your content as needed to operate and improve the Service. This license ends when you delete the content or your account, except as necessary to comply with law or enforce these Terms.
- Public-domain books — book text on the Service is sourced from Project Gutenberg or other public-domain libraries and is provided for personal reading. Your highlights and notes refer to that content but do not give you any rights to the underlying text beyond what public-domain status already provides.
3. Acceptable use — no-tolerance content policy
We have zero tolerance for objectionable user-generated content. You will not, and you will not let any third party, post or transmit content that is:
- harassing, threatening, bullying, hateful, or that targets people based on race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, age, disability, or other protected characteristic;
- sexually explicit, sexualizes minors, or contains nudity;
- violent, gory, or that promotes self-harm, suicide, or eating disorders;
- promoting illegal activity, drug sales, or weapon trafficking;
- spam, scams, malware, phishing, or unsolicited advertising;
- impersonating another person, organization, or our staff;
- infringing the intellectual property, privacy, or publicity rights of others;
- otherwise unlawful or grossly offensive in our reasonable judgment.
We reserve the right to remove content and terminate accounts that violate this policy at our discretion, with or without notice. You also agree not to attempt to disable, reverse-engineer, scrape, or interfere with the Service.
4. Reporting + moderation
- Every user can report any annotation or comment via the in-app Report button. We aim to review reports and take action where appropriate within 24 hours.
- We use OpenAI's moderation API as an automated first line of defense to filter obvious abuse on submission. This is not a substitute for human review.
- We may take action against accounts that repeatedly violate this policy, including content removal, temporary suspension, or permanent termination without refund or notice.
- If your content is removed and you believe it shouldn't have been, contact us at the address below.
5. Blocking
Users can block each other. Blocking removes follow relationships in both directions and prevents the blocked user from interacting with you on the Service. Blocking is a tool for personal safety and is not a substitute for reporting policy violations.
6. Account termination + deletion
- By you — you can delete your account at any time from the Profile screen. Deletion is immediate and irreversible: your profile, shelf, highlights, notes, comments, likes, follows, blocks, and reports will be removed.
- By us — we may suspend or terminate your account if you violate these Terms, if required by law, or if continuing to provide service to you would expose us or other users to legal or safety risk. Where practical we will tell you why.
7. Service changes + availability
We may change, suspend, or discontinue any part of the Service at any time. We don't promise the Service will be available without interruption or free of bugs. We may update these Terms; if we make material changes we will update the "Last updated" date and notify you in-app or by email.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
9. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, DOGEAR AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR REVENUES. OUR TOTAL LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNT YOU HAVE PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM, WHICHEVER IS GREATER.
10. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your content, or your violation of these Terms.
11. Governing law + disputes
These Terms are governed by the laws of the State of Washington, USA, without regard to conflict-of-law principles. Disputes will be brought exclusively in the state or federal courts located in King County, Washington, and you consent to jurisdiction there. Nothing in these Terms prevents either party from seeking injunctive relief in any court of competent jurisdiction.
12. Apple App Store additional terms
If you obtained the app from Apple's App Store, the following also apply: these Terms are between you and us, not Apple. Apple has no obligation to provide maintenance or support. To the extent allowed by law, Apple's maximum liability for any failure of the app to conform to a warranty provided by us is limited to the price you paid for the app (which is zero). Apple is a third-party beneficiary of these Terms and may enforce them against you.
